Car Insurance Chevrolet (Car Insurance). Is the Lemon Law in effect?Is the Lemon Law in effect? My father bought a used car from some tow company and signed a paper saying he bought it 'as is'. However, 2 days after, we brought it to a mechanic thinking it only needed a big tune up and the mechanic told us it pointless and we should just bring it back. Is the lemon law in effect even though we signed the 'as is' paper? There are no Lemon Laws that apply to used cars is Mass. Sorry (though the people saying that Lemon Laws in general only apply to new cars are also mistake: it depends entirely on the state you're in). It depends upon which State the car was purchased or leased in. Some states include used and leased cars in their Lemon Law statutes. Some states have separate laws for used vehicles. Some states provide protection only for new cars. Nope. The Lemon Law is in effect. However, you first need to know what constitutes a "Lemon." According to the law, a lemon is any vehicle that has a problem, that is covered by warranty, that "substantially impairs the use, value or safety of the vehicle" to you and which the dealer has not fixed within a reasonable number of chances. There are two key components to this. First, the warranty. You bought a car without one. Second is "not fixed within a reasonable number of chances." If your car WAS covered under warranty, lemon law doesn't allow you to simply return because it has problems. You bring it back to be FIXED. When fixing doesn't work over several tries, you can ask for relief under the law. Your case misses the boat on both counts. In the future, taking the car to a mechanic BEFORE you buy it is something you should always do with a used car. We wouldn't be having this discussion if you had. Having said all this, you could try to return the vehicle. As a good business gesture, the company might take it back considering your situation. As far as court goes, you don't have a leg to stand on with that "as is" paperwork in the sellers hand. Better luck next time. AS-IS means that you accept the car in the condition that it is in, with no warranties expressed or implied. No lemon law is in effect for this transaction. The definition of 'as-is' is pretty straight forward. Next time I bet your Dad will take it to a mechanic for an inspection BEFORE he decides to purchase a vehicle. Pretty clear here that the answer is NO. You bought a car from a towing company which means it was left somewhere by someone who no longer wanted it. They sold it to recover their fees. It doesn't even qualify as a "used car". It was an abandoned car. You got it cheap (hopefully) so deal with it. Fix it or sell it. It needed some fixing up but one thing I can't figure out is why it makes a clicking sound, exactly the same noise as when the turn signal is on (the tick tock noise).
